This Privacy Policy explains how Surge AI, a service of Freshwall & Co Inc, a New York State S-Corp (“Surge AI,” “we,” “us,” or “our”), collects, uses, and protects information when you visit surgemarketing.ai (the “Site”) or interact with our demo booking, forms, or chat tools.

By using the Site, you agree to the practices described in this policy. This policy works alongside our Terms of Service.

1. Information We Collect

Information you provide directly, such as through the demo booking form, pre-qualification survey, or WhatsApp chat widget:

• Full name
• Business name and industry
• Phone number (WhatsApp preferred)
• Email address
• Business details you share (revenue range, customer volume, current tools, biggest challenges)

Information collected automatically when you browse the Site:

• IP address and approximate location
• Browser type, device type, and operating system
• Pages visited, time on site, and referral source
• Cookie and pixel data (see Section 3)

2. How We Use Your Information

We use the information we collect to:

• Evaluate your inquiry and determine fit for a demo or Surge AI services
• Contact you about your inquiry, demo booking, or account
• Route and score leads internally
• Improve the Site and our marketing based on aggregate usage patterns
• Run and measure advertising campaigns (Google Ads, Meta/Facebook Ads)
• Comply with legal obligations and enforce our Terms of Service

3. Cookies, Pixels, and Advertising Technology

Google Ads. We use Google Ads and Google Ads conversion tracking to measure the performance of our ad campaigns and to show relevant ads to people who have visited our Site. • Service providers who help us operate the Site and our business, including our CRM and automation platform, payment processor (Stripe), and hosting/infrastructure providers. These providers only receive the information needed to perform their function and are not permitted to use it for their own purposes.
• Advertising platforms (Google, Meta) receive limited technical data (such as pixel/cookie identifiers and conversion events) as described in Section 3, but not your name, phone number, or business details, unless you separately provided that information directly to those platforms (for example, by clicking an ad and filling out a form hosted by them).
• Legal requirements, such as if required by law, subpoena, or to protect the rights, property, or safety of Surge AI, our clients, or others.
• Business transfers, such as a merger, acquisition, or sale of assets. You would be notified of any change in ownership or use of your information.

5. Data Retention

We retain your information for as long as needed to respond to your inquiry, provide services if you become a client, and comply with legal, accounting, or reporting obligations. If you were not a good fit or did not move forward, your intake information may still be retained for a reasonable period for follow-up and internal record-keeping, unless you request deletion (see Section 7).

6. Data Security

We take reasonable technical and organizational measures to protect your information, including relying on the security practices of our platform providers (our CRM/automation platform and Stripe). However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Your Rights and Choices

Depending on your location, you may have rights to:

• Request access to the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your information
• Opt out of marketing communications (you can also reply “stop” to WhatsApp messages or unsubscribe from emails)
• Opt out of personalized advertising via the Google and Meta links in Section 3

8. Children’s Privacy

The Site is intended for business owners and decision-makers. It is not directed at children, and we do not knowingly collect information from anyone under 18.

The Site may link to third-party services (including WhatsApp, Meta, Google, and Stripe). This Privacy Policy does not cover their practices. Please review their privacy policies separately.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes take effect when posted to this page, with the “Last Updated” date revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the updated policy.
